Terms of Service

Acceptance of Terms

These Terms of Service govern your access to and use of DMME's websites, applications, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility and Age-Restricted Content

You must be at least 18 years old, legally able to enter into a binding agreement, and permitted to use the Service under applicable law. DMME may offer standard digital content and optional age-restricted content. Only eligible creators may publish age-restricted content, and viewers may access it only after explicitly enabling access and confirming that they meet applicable age requirements. Prohibited content remains prohibited regardless of age confirmation or verification.

Accounts and Access

You must provide accurate information, keep your account information current, and protect access to your account. You are responsible for activity conducted through your account. You may not impersonate another person, transfer your account without permission, create an account for someone else, or use the Service after your access has been suspended or terminated. DMME may offer or change supported authentication methods and account features over time.

Creator Responsibilities and Verification

Creators are responsible for the content they upload, publish, send, offer, or sell, including accurate descriptions, prices, availability, and fulfillment expectations. Creators must have all rights and permissions necessary for their content, comply with applicable law, and complete any required identity, tax, payment, or payout processes before withdrawing earnings.

Creator verification is discretionary, may be limited in scope, and may be revoked at any time. A verification indicator does not guarantee a creator's identity, trustworthiness, legality, or conduct beyond the limited status DMME chooses to display. Verified creators may be subject to additional eligibility, compliance, or conduct requirements.

Viewer Responsibilities and Content Requests

Viewers may use creator content only for personal, lawful purposes. Viewers may not redistribute, publish, sell, record, copy, or otherwise exploit private or paid content without the creator's and DMME's express permission. Viewers must submit lawful and respectful content requests and must not use purchases, reports, refunds, or chargebacks abusively.

A viewer may submit a content request, but a request does not guarantee acceptance, delivery, or any particular response. Creators are not obligated to fulfill requests. Inappropriate, unlawful, or policy-violating requests may be removed and may result in moderation or account action.

Acceptable Use and Prohibited Content

You may not upload, request, sell, send, or promote content or conduct that is unlawful, non-consensual, exploitative, fraudulent, threatening, harassing, hateful, violent, deceptive, or invasive of another person's privacy. Content involving minors, sexual exploitation, trafficking, coercion, intimate imagery shared without consent, or instructions to commit serious wrongdoing is strictly prohibited.

Content Availability and Expiration

Under DMME's current product rules, published and purchased content is generally available for approximately 24 hours. Availability may end sooner or be restricted when required for safety, moderation, technical, legal, or operational reasons. Content expiration does not remove transaction, payment, tax, moderation, security, compliance, legal, or other business records that DMME may retain.

Wallets and Individual Content Purchases

Viewers may add funds to an in-app wallet and use the available wallet balance to purchase individual pieces of digital content. Each content purchase is a separate transaction. Wallet balances are platform balances, not bank accounts; they are not FDIC insured and do not accrue interest. If DMME offers promotional credits, they may expire and may be subject to separate rules displayed with those credits.

Payments, Earnings, and Withdrawals

Purchases, wallet funding, creator earnings, fees, holds, releases, and withdrawals are subject to the prices and conditions shown in the Service. Payment providers and payment availability may vary by account eligibility, content type, location, or other lawful considerations, and DMME may change providers without notice.

Creator earnings become eligible for withdrawal only after the applicable settlement period and satisfaction of any required payout conditions. DMME may delay, hold, reserve, reverse, or adjust wallet activity, earnings, or payouts for fraud prevention, disputes, refunds, chargebacks, compliance reviews, reserve requirements, legal obligations, or suspected violations of these Terms. Transaction records maintained by DMME and its payment providers may be used to administer the Service and resolve payment disputes.

Refund Policy

Except where required by law or expressly stated in the Service, purchases are final once digital content is made available. Any handling of a rejected, canceled, disputed, or expired request is governed by the applicable rules shown in the Service and applicable law. Payment-provider refund, dispute, and chargeback processes may also apply.

Intellectual Property and Limited Viewer Rights

Creators retain ownership of the content they create. Creators grant DMME a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and adapt their content only as reasonably necessary to operate, secure, moderate, and improve the Service. Creators represent that their content does not infringe another person's rights.

A viewer receives only the limited, personal right to access content expressly made available through the Service during its available period. No purchase transfers ownership or grants a right to redistribute, record, resell, download, copy, or create derivative works from content unless the creator and DMME expressly permit it.

Copyright Notices

We respond to valid notices of claimed copyright infringement and may terminate repeat infringers. A notice should identify the copyrighted work, the allegedly infringing material and its location, your contact information, required good-faith and accuracy statements, and your physical or electronic signature. Notices may be sent to hello@dmme.social.

Moderation and Enforcement

DMME may investigate reported or suspected violations and, in its discretion, remove content, suspend visibility, freeze wallet activity, delay or hold payouts, restrict features, suspend or terminate accounts, or preserve information. We may cooperate with law enforcement or disclose information when legally required or permitted to protect users, the public, or the Service. These actions do not limit other rights or remedies available to DMME.

Third-Party Services

The Service may rely on third-party providers for payments, authentication, storage, communications, analytics, security, and other operational functions. Your use of those functions may be subject to the providers' applicable terms and policies. DMME may add, remove, or change providers and platform features as the Service develops.

Termination and Record Retention

You may stop using the Service or request account deletion at any time. DMME may suspend, restrict, or terminate access when reasonably necessary to enforce these Terms, protect users, prevent fraud or harm, comply with law, or address risk to the Service. DMME may retain information required for security, compliance, tax, legal, moderation, payment, and operational purposes as described in the Privacy Policy and as permitted or required by law.

Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." DMME does not guarantee that the Service, any creator, any viewer, any request, any content, or any payment feature will be uninterrupted, secure, accurate, available, or suitable for a particular purpose. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, DMME and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from or relating to the Service. This limitation applies only to the extent permitted by applicable law and does not limit liability that cannot lawfully be limited or excluded.

Disputes and Applicable Law

These Terms do not waive rights that cannot be waived under applicable law. DMME has not stated an arbitration procedure, class-action waiver, governing-law selection, or exclusive venue in these Terms. If DMME adopts any such provision in the future, it will be presented in an updated version of these Terms and, where required, with additional notice or consent.

Changes to Terms

We may update these Terms as the Service develops or legal and operational requirements change. We will post the updated Terms and revise the Last Updated date. When required, we will provide additional notice or request renewed consent. Continued use after an update becomes effective constitutes acceptance of the revised Terms.
