Acceptance of Terms
These Terms of Service govern your access to and use of DMME's invite or beta social platform, websites, applications, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. By using DMME, you represent and warrant that you satisfy these requirements and are not prohibited from using the Service under applicable law.
Accounts
You must provide accurate information, keep your account information current, and protect access to your account. You are responsible for activity conducted through your account. You may not impersonate another person, transfer your account without permission, create an account for someone else, or use the Service after your access has been suspended or terminated.
Creator Responsibilities
Creators are responsible for content they upload, offer, sell, or deliver and for setting accurate descriptions, prices, availability, and fulfillment expectations. Creators must have all rights and permissions necessary for their content, comply with applicable law, fulfill accepted requests as represented, and complete required identity, tax, or payout processes before withdrawing earnings.
Viewer Responsibilities
Viewers must use creator content only for personal, lawful purposes. Viewers may not redistribute, publish, sell, record, or otherwise exploit private content without the creator's express permission. Viewers must submit lawful, respectful content requests and must not use offers, payments, reports, refunds, or chargebacks abusively.
Prohibited Content
You may not upload, request, sell, send, or promote content that is unlawful, non-consensual, exploitative, fraudulent, threatening, harassing, hateful, violent, deceptive, or invasive of another person's privacy. Content involving minors, sexual exploitation, trafficking, coercion, intimate imagery shared without consent, or instructions to commit serious wrongdoing is strictly prohibited.
Illegal Content
DMME may remove, preserve, restrict, or report content or activity that we reasonably believe violates law or creates a risk of harm. We may cooperate with lawful investigations and make reports to appropriate authorities or designated reporting organizations when required or permitted by law.
Copyright
You retain ownership of content you create. You grant DMME a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and adapt your content only as reasonably necessary to operate, secure, moderate, and improve the Service. You represent that your content does not infringe another person's intellectual property rights.
DMCA
We respond to valid notices of claimed copyright infringement under the Digital Millennium Copyright Act and may terminate repeat infringers. A notice should identify the copyrighted work, the allegedly infringing material and its location, your contact information, required good-faith and accuracy statements, and your physical or electronic signature. Notices may be sent to hello@dmme.social.
Payments
Purchases, wallet funding, creator earnings, fees, holds, releases, and withdrawals are subject to the prices and conditions shown in the Service. Payments may be processed by third-party payment processors and are also subject to their terms. You authorize applicable charges and agree that transaction records maintained by DMME and its payment providers may be used to resolve payment disputes.
Refunds
Except where required by law or expressly stated in the Service, purchases are final once digital content is made available or a request is fulfilled. Holds for rejected, canceled, or expired requests may be released according to the request rules shown in the Service. Third-party payment processor refund, dispute, and chargeback policies may also apply.
Subscriptions
DMME may offer subscriptions in the future. Before a subscription is purchased, the Service will disclose its price, billing frequency, renewal terms, included benefits, and cancellation method. Unless otherwise stated, subscriptions may renew automatically until canceled, subject to applicable law and payment processor terms.
Termination
You may stop using the Service or request account deletion at any time. DMME may suspend, restrict, or terminate access when reasonably necessary to enforce these Terms, protect users, prevent fraud or harm, comply with law, or address risk to the Service. Financial, moderation, safety, and audit records may be retained as permitted or required by law.
Content Removal
We may remove or limit access to content that violates these Terms, applicable law, payment processor requirements, or our safety rules. We may also remove unavailable, expired, technically harmful, or disputed content. Removal does not waive any other right or remedy.
Privacy
Our Privacy Policy explains how we collect, use, and share information. It is incorporated into these Terms by reference.
Limitation of Liability
To the fullest extent permitted by law, the Service is provided "as is" and "as available." DMME disclaims warranties not expressly stated in these Terms. DMME and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Any limitation applies only to the extent permitted by applicable law.
Changes to Terms
We may update these Terms as the Service develops or legal and operational requirements change. We will post the updated Terms and revise the Last Updated date. When required, we will provide additional notice or request renewed consent. Continued use after an update becomes effective constitutes acceptance of the revised Terms.
